LABOUR COMMISSION SEEKS ORDER TO ENFORCE DIRECTIVES
29/08/2006

Reference the Daily Graphic dated Thursday, May 25, 2006.

The National Labour Commission (NLC) has applied to an Accra High Court for an order to compel Ghana Breweries Limited (GBL) to pay redundancy benefits to the company's former Secretary, Mr. Joe Aboagye Debrah.

According to a statement from the Commission, the action followed the refusal of GBL to obey earlier orders by the Commission as well as the High Court.

It accused the GBL of defying the Commission as well as Court to pay redundancy benefits to the company's former secretary in accordance with an agreement on the benefits for staff made redundant last year.

Furthermore, the Commission is praying the Court to order GBL to pay the benefits with interest at the prevailing commercial rate with effect from July 1, 2005.

The Commission's statement said the redundancies occurred following the merger between the company and Guinness Ghana Limited as a result of which Mr. Debrah petitioned the NLC on July 18, 2005 for the payment of his entitlements in accordance with the terms of the redundancy agreement reached on June 9, 2005.

The Commission subsequently ruled in favour of the petitioner and directed Ghana Breweries to comply but the company applied to the High Court seeking an order to quash the ruling.

On March 23, 2006, the High Court, presided over by Justice Irismay Brown, dismissed the application by Ghana Breweries and directed the company to comply with the ruling.

Ghana Breweries has so far not complied with the decision to the Commission as well as the directives of the High Court, the statement concluded.
